Women cannot be denied employment citing work during night hours; "only male candidates" job notification unconstitutional: Kerala High Court

The restrictions on work timings beyond for women under Section 66(1)(b) of the Factories Act, 1948 cannot be an excuse to deny employment to a woman who does not require such protection anymore, the Court ruled.

Almost half the women in 57 developing countries around the world, including India, don’t have enough bodily autonomy to say ‘no’ to sex, a new report by the United Nations has found. The report defined ‘bodily autonomy’ as the “power and agency to make choices, without fear of violence or having someone else decide for us.” And in order to measure the extent of bodily autonomy women enjoyed, they assessed whether women had the right to the following: first, deciding when or with whom to have sex; second, choosing when or whether they want to become pregnant, and third, freedom to access and access to doctors. Titled My Body is My Own, the study was conducted by the United Nations Population Fund (UNFPA), and found that many of the 57 countries not only restrict women’s movement outside the home but also are yet to criminalize marital rape and allow rapists impunity if they simply agree to marry the survivor. Only 55% of the women in these countries reported feeling fully empowered to make choices on sex, contraception, and health care. “The denial of bodily autonomy is a violation of women and girls’ fundamental human rights that reinforces inequalities and perpetuates violence arising from gender discrimination,” according to Natalia Kanem, executive director of the @unfpa. Janaki Devi is from Uttar Pradesh. She works in a Janaki Devi is from Uttar Pradesh. She works in a school as a sanitation worker. Before the pandemic she used to get  INR 3000 per month and after the pandemic when schools reopened she got INR 1500 per month. The salary is so low that she can't afford her daily needs. She goes to school at 7am and comes back at 4pm. Even on Sundays she works for 4hours. She didn't get any holiday even during festivals. She gets tired after working for hours in school. Sometimes she is so tired that she can’t cook for herself at night that she goes to sleep empty stomach.

She used to work as a Manual scavenger in an upper caste household. But was paid very low. When she asked for a pay rise they asked them to leave. She left the job. Her husband is no more. She had to face a lot of difficulties raising her kids alone.

She filled the form for Pradhan Mantri Awas Yojana but it's been 4 months she has been running in the office but didn't get any help. 

Untouchability is practiced in her village. People who belong to the lower caste are not allowed to use the well in the village. 

Janaki Devi wished to live a stable life.
